    § 1. The freedom of press, speech, writing, publication, and of the expression of opinion with narrowly prescribed exceptions for demonstrably injurious discourse.

    Justification

    The freedom of the press. We can see that the freedom of speech, writing, publication and the freedom of the expression of the opinion are included in the article, but there is not a reference to the freedom of the press. It constitutes a discrete constitutional guarantee and it should be part recognised and included in the Scottish Constitution. The goal is to prevent the government from interfering with the distribution of information and opinions. Through its broader informative function, press freedom moreover undermines the exercise of many other rights and freedoms. It provides citizens with the means not only to express themselves, but also with the opportunity to govern themselves in a well-informed manner. Press function is linked with the public’s right to know.
